Minutes of the regular meeting of the

Johnson City Zoning Board of Appeals held on

July 14, 2008 at 7:30pm at

243 Main St., Johnson City, NY

 

Present:           Vernon Rowlands, Chairman

                        Dr. Steve Holowinski

Edward Mazanek

                        Charles Snedaker                   

                        Beth Westfall, Attorney

                        Daria Golazeski, Planning Director

                        Ken Jennison, Building Inspector & Code Officer

 

Absent:            None

 

A brief work session was held at 7:00pm.(Planner Golazeski informed the Board during the work session that Robert Deemie has resigned as a member of the Zoning Board of Appeals.)

 

Chairman Rowlands called the meeting to order at 7:30pm.

 

Chairman Rowlands noted the emergency exits.

 

Minutes – A motion to accept the minutes of the June 9, 2008 regular meeting was made by Dr. Holowinski and seconded by Mr. Snedaker. The motion carried.

OLD BUSINESS

 

Area Variance- DMW Services, Inc. - Joe Watson, 36 Third Street

 

The application is an area variance request to reduce the minimum required lot frontage from 60 feet to 45 feet to allow for the conversion of the building from a single family dwelling to a two family dwelling. The applicant, Joe Watson, was present.

 

Chairman Rowlands reminded the board and all those in attendance that the Public Hearing for this application has already been held and was closed at the June 9th meeting. He also stated that the board had received a letter and packet of information from Julie Deemie regarding this application and has had time to review the additional information submitted by Mr. Watson.

 

Mr. Mazanek stated that there is enough parking and that the lot size is greater than the 6,000sq. ft. required for a two-family dwelling in this zoning district. The board has received a petition of support from several of the neighbors of this property. The Planning Board felt that this was a self created hardship, however there seems to be conflicting evidence regarding this and it cannot be proven.

 

A motion to approve the area variance to reduce the minimum required lot frontage from 60 feet to 45 feet including the department head comments was made by Mr. Mazanek and seconded by Mr. Snedaker.

Yes – 4 (Holowinski, Mazanek, Rowlands, Snedaker)         No – 0          Absent – 0
