Johnson City Zoning Board of Appeals held on

August 13, 2007 at 7:30pm at

The work session was held at 7:00pm.

 

Chairman Rowlands called the meeting to order at 7:30pm.

 

Chairman Rowlands noted the emergency exits.

 

Minutes – A motion to accept the minutes of the July 9, 2007 regular meeting was made by Mr. McSain   and seconded by Mr. Deemie. The motion carried.

Public Hearing

Area Variance – John David Dudack, 62 Albany Avenue

 

The applicant is requesting an area variance to increase the maximum allowable lot coverage from 30% to 41% or 589.58 sq. ft. more than the code allows for the construction of a 3-car garage.

 

The applicant, Mr. John David Dudack, was present.

 

Chairman Rowlands opened the public hearing.

 

Mr. Dudack explained that he has 2 cars, a motorcycle and a lawn tractor and has been renting a garage for 10 years. The house is a two family dwelling though it has been used more as a single family dwelling for many years. His parents lived on the first floor and he lived on the second floor. He plans on renting out the apartment at his home at some point in the future and wants to provide an off-street parking space for a tenant. Mr. Dudack explained that there is a lack of available parking on the street.

 

Mr. Dudack brought several photos of area garages, which he passed around for the board to see. He also presented a petition signed by 94% of his neighbors in support of his variance.

Chairman Rowlands asked if Mr. Dudack would be putting up a fence between his property and the rear neighbor. Mr. Dudack stated that there is already a fence there.

 

Mr. Dudack will have a concrete driveway to two of the garage bays, it will be professionally built and landscaped. Water runoff will be addressed by his contractor.

 

Mr. Richard Panatek, neighbor of Mr. Dudack, spoke in support of the application.

 

Chairman Rowlands closed the public hearing.

 

Chairman Rowlands read the department head comments.

 

DEPARTMENT HEAD COMMENTS

 

Code Enforcement:                I did go and look at the property.  I feel that it is consistent with the other neighboring properties as far as garage or out building setbacks. I do not feel the area setback request is an issue. If approved, the building must comply with all NYS Building Codes.

Fire:                                        NCI                                   

Planning Dept.:                      Is this the minimum required to accomplish objective? Seems size permitted without variance is 12ft. x 20 ft.

Police:                                     NCI

Public Works:                         More information is required regarding storm water runoff that will be added with the addition of the roof and driveway. There could be an impact to the adjoining properties during large intensity rainfall events.

Water:                                    NCI         

JC Planning Board:              Recommend approval for the area variance application for a 24’ x 24’ garage with an uncovered paved parking space.

 

Mr. McSain asked if the garage would have electricity to it. Mr. Dudack stated that yes it would be and it would be underground. There would be no plumbing.

 

Mr. McSain asked about water runoff and it’s effect on the property behind him.

 

Mr. Dudack hopes to buy the house and the vacant lot behind him and someday demo the existing house and build a new house.

 

Planner Golazeski advised the board that the runoff issue would be addressed during the building permit application process.

                                     

A motion to approve the area variance to increase the maximum lot coverage from 30% to 41% for 62 Albany Avenue including the department head comments was made by Dr. Holowinski and seconded by Mr. Mazanek.

 

Motion Carried Vote:    Yes – 5                    No – 0             Absent – 0
